Subclass 491 Skilled Work Regional (Provisional) Visa Explained

State or territory nomination. A state nominates you for a 491 much as it would for a 190, but against its regional criteria and its regional occupation list. Conditions are often lighter than for the 190 — the state is asking you to go somewhere it needs people.

Family sponsorship. An eligible relative who is an Australian citizen or permanent resident and lives in a designated regional area can sponsor you. Eligible relatives typically include a parent, child, sibling, aunt or uncle, niece or nephew, or grandparent. The relative must usually be resident in the designated regional area.

Both routes give the same 15 points and the same visa. The family route is underused, largely because applicants do not realise how broadly "eligible relative" is defined.

• Nomination or sponsorship — state/territory, or eligible relative in a designated regional area.
• Occupation on the relevant list for that nomination route.
• Positive skills assessment in the nominated occupation, valid at application.
• Under 45 at invitation.
• Competent English minimum.
• At least 65 points, including the 15 nomination points.
• An invitation after an EOI in SkillSelect.

Unlike the 190, the 491 carries conditions on the visa itself. In substance you must live, work and study only in a designated regional area for the duration of the visa.

This is not advisory. Your subclass 191 application depends on demonstrating compliance, and a period spent living or working outside the designated area can break the pathway you took the visa for. Keep evidence throughout — tenancy agreements, employment records, utility accounts, tax returns.

The 491 is a five-year commitment to regional Australia in exchange for 15 points and a permanent residence pathway. It is an excellent deal if regional Australia is somewhere you would genuinely live. It is a bad deal if you are planning to breach it.

After holding the 491 for at least three years and complying with its conditions throughout, you can apply for the subclass 191 Permanent Residence (Skilled Regional) visa, provided you have met a minimum taxable income requirement for the relevant period.

The income requirement is where applicants come unstuck — particularly those in part-time work, extended unpaid leave, or self-employment with low declared income. Treat it as a target from year one.

Two reasons. First, the 15 points frequently move an engineer from "waiting indefinitely" to "invited", and engineering occupations are well represented on state regional lists.

Second, the regional definition is generous. Perth, Adelaide, Canberra, Hobart, Newcastle, Wollongong, Geelong and the Gold Coast are all designated regional areas, and between them they contain a substantial share of Australia's engineering employment — defence shipbuilding in Adelaide, resources in Perth, heavy industry in the Hunter and Illawarra.
